Title IX & Sexual Misconduct


Coast Community College District's Commitment to Title IX and Sexual Respect

Title IX of the Education Amendments of 1972 states that "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

Every Coast Community College District (CCCD) student, employee, and visitor has the right to flourish academically and professionally in an environment free from sexual misconduct, sexual harassment, and all forms of gender-based discrimination and violence. The District responds promptly and equitably to all reports of sexual misconduct. We encourage members of our community to report incidents of sexual misconduct or other inappropriate behavior, to familiarize themselves with the District's related policies and procedures, and to seek the care and support they deserve.

Responsible Employee Statement

A Responsible Employee who becomes aware of sexual assault or misconduct is required to report all related information immediately to the Title IX Coordinator for their site. All District employees, with the exception of student workers and licensed counselors in the Golden West College and Orange Coast College Student Health Centers, are Responsible Employees. District Policy on Sexual Misconduct

Board Policy and Administrative Procedure 5910: Sexual Misconductincludes this definition of sexual misconduct: it "comprises a broad range of unwelcome behaviors focused on Sex and/or gender that may or may not be sexual in nature. Any intercourse or other intentional sexual touching or activity without the other person's Consent is Sexual Assault, and is a form of Sexual Misconduct under this Policy. Sexual Misconduct encompasses Sexual Harassment, Sexual Assault, Sexual Exploitation, or Gender-based Harassment, which is a form of Harassment based on gender identity, gender expression, or non-conformity with gender stereotypes. Sexual Misconduct may also encompass acts of a sexual nature, including acts of Sexual Stalking, Domestic Violence, and Dating Violence, intimidation, or for Retaliation following an incident where alleged Sexual Misconduct has occurred.


Sexual Misconduct can occur between strangers or acquaintances, or people who know each other well, including between people involved in an intimate or sexual relationship, can be committed by anyone regardless of gender identity, and can occur between people of the same or different Sex or gender."

All members of the CCCD community should also be aware of their rights as articulated in Education Code Section 221.8:


The following list of rights, which are based on the relevant provisions of the federal regulations implementing Title IX of the Education Amendments of 1972 (20 U.S.C. Sec. 1681 et seq.), may be used by the department for purposes of Section 221.6:


  • (a) You have the right to fair and equitable treatment and you shall not be discriminated against based on your sex.
  • (b) You have the right to be provided with an equitable opportunity to participate in all academic extracurricular activities, including athletics.
  • (c) You have the right to inquire of the athletic director of your school as to the athletic opportunities offered by the school.
  • (d) You have the right to apply for athletic scholarships.
  • (e) You have the right to receive equitable treatment and benefits in the provision of all of the following:
    • (1) Equipment and supplies.
    • (2) Scheduling of games and practices.
    • (3) Transportation and daily allowances.
    • (4) Access to tutoring.
    • (5) Coaching.
    • (6) Locker rooms.
    • (7) Practice and competitive facilities.
    • (8) Medical and training facilities and services.
    • (9) Publicity.
  • (f) You have the right to have access to a gender equity coordinator to answer questions regarding gender equity laws.
  • (g) You have the right to contact the State Department of Education and the California Interscholastic Federation to access information on gender equity laws.
  • (h) You have the right to file a confidential discrimination complaint with the United States Office of Civil Rights or the State Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.
  • (i) You have the right to pursue civil remedies if you have been discriminated against.
  • (j) You have the right to be protected against retaliation if you file a discrimination complaint.
