What is Sexual Assault?

 

Sexual assault includes but is not limited to rape, forced anal intercourse, forced copulation, rape by foreign object, sexual battery, or threat of sexual assault. These include situations in which the suspected perpetrator sexually assaults a person incapable of giving consent, including where the person is prevented from resisting due to alcohol or drugs and the condition was known, or reasonable should have been known by the accused. Intoxication of the assailant shall not diminish the assailant’s responsibility for sexual assault.
